Background In 2012, UNDP began implementation of a rule of law program in the post-crisis area of Malakand Division, Khyber Pakhtunkhwa (KP). Based out of Peshawar, the Strengthening the Rule of Law Programme (SRLP) is currently in the process of expanding its activities to include three additional districts in KP as well maintaining program activity in all 7 districts of Malakand Division.

SRLP is unique for having a 25% cost-sharing agreement with the Khyber Pakhtunkhwa (KP) Provincial Government for its entire budget, indicative of strong government commitment and partnership. SRLP is funded by the Swiss Development Cooperation (SDC), Kingdom of Netherlands (EKON), the European Union (EU) as well as UNDP. Under the joint EU-UNDP Rule of Law Program, the EU is providing specific funding for Policing as well as Alternative Dispute Resolution (ADR) components.

SRLP is oriented around four main and reinforcing goals: (i) enhancing access to justice and legal aid; (ii) building the capacity of Courts for greater service delivery; (iii) supporting ‘informal’ justice mechanisms (Alternate Dispute Resolution (ADR) system) to provide just and speedy services; and (iv) strengthening Police and Prosecution capacity.

One major component of the Program’s support of ADR is to support the training of Community Paralegals. Community Paralegals can serve as a bridge between the formal legal system and communities, making state justice institutions more accessible to people. Currently, there is no standard course for training of Community Paralegals and most people are unaware of Community Paralegals. Supporting a course for Community Paralegals at a local university will ensure the proper training of Community Paralegals, clarifying their roles and reducing overlap and potential friction with lawyers. Over the longer term, Community Paralegals will increase people’s awareness of their legal rights and increase access to the legal system. At the same time, the Program envisages the Courts benefiting from Community Paralegals by reducing the number of cases through their mediating of minor disputes and referral of civil matters to the Panel of Conciliators at the community level.

Duties and Responsibilities The Expert consultant will develop a Community Paralegals course at a University in Khyber Pakhtunkhwa, which will include an initial assessment, the development of a curriculum, the development of course material and the training of faculty members. Duties and responsibilities include: · Submitting (i) a workplan for completion of the consultancy and (ii) a final report summarizing activities undertaken during the consultancy period and recommendations; · Undertaking a needs assessment to ascertain the functions to be performed by a community paralegals; · Based on the assessment, creating a curriculum for Community Paralegals targeting members of the community; · Developing course materials; · Presenting the curriculum to University faculty, UNDP and other stakeholders and further training of faculty members to prepare them to instruct Community Paralegal courses; · Undertaking any other tasks as required by the Chief Technical Specialist for achieving program results.

Deliverables: · Activities workplan submitted to UNDP (2 days); · Needs assessment completed and presented to UNDP and University of Malakand (8 days); · Community Paralegals’ Course designed and submitted to UNDP and University of Malakand for review (16 days); · Training completed at Malakand University for 8 faculty members (4 days); · Curriculum endorsed by University of Malakand submitted (5 days);

Institutional Arrangement and Duty Station The expert consultant, under the direct supervision of the Chief Technical Specialist (CTS) or her designate and in close cooperation with other members of the ADR Output team and other SRLP staff, will undertake the activities as set forth in this TORs in a timely, efficient and professional manner.
The expert consultant will regularly report to the Chief Technical Specialist. The expert consultant will closely work with a local university in Khyber Pakhtunkhwa (as designated by the Program), and correspond with donors and other partners as necessary. The expert consultant will primarily be based in the UNDP Regional Office located in Peshawar, Pakistan but will spend a considerable amount of time at the local University. The Consultant may periodically travel to Islamabad and regions where SRLP is implementing activities in Khyber Pakhtunkhwa. Work related traveling arrangements will be arranged by SRLP.

Duration of Work The expected duration of work will be 35 Working Days (from 1st November to 14th December 2015)

Scope and Schedule of Payments Payments provided to the consultant under this contract will be an ‘all inclusive’ amount paid in accordance with the schedule of payments set forth below. The term ‘all-inclusive” implies that all costs (professional fees, travel related expenses, communications, utilities, consumables, insurance, etc.) that could possibly be incurred by the Consultant are already factored into the financial proposal. Under this arrangement, the contract price will be fixed regardless of change in the cost components. Payments will be made only upon confirmation of UNDP on delivering on the contract obligations in a satisfactory manner. · 15% upon submission of activities workplan; · 15% upon undertaking needs assessment and presentation to UNDP and University of Malakand; · 30% upon Community Paralegals’ course designed and submitted to UNDP and University of Malakand for review; · 20% upon conducting training at Malakand University for 8 faculty members; · 20% upon submission of training curriculum endorsed/approved by University of Malakand

Individual Consultants are responsible for ensuring they have vaccinations/inoculations when travelling to certain countries, as designated by the UN Medical Director. Required Skills and Experience Education: · Advanced university degree in law or a related field; a combination of relevant academic qualifications and extensive experience may be accepted in lieu of the advanced university degree.

Experience: · 5+ years of progressively responsible professional experience related to paralegal work, legal aid to community members, as well as experience moderating workshops, leading trainings and drafting reports; · Of which 5+ years of experience in developing University based curriculum, training manuals with components like laws, constitution, human rights, referrals, roles and responsibilities, record maintenance, drafting, community based voluntary work, conducting community level awareness campaigns, community paralegals; · Familiarity and experience in the region (especially Pakistan as well as Afghanistan) and crisis settings strongly preferred; · Experience in working or undertaking consultancy work with UN organizations, in addition to experience interacting with regional and international stakeholders/donors in a multicultural environment preferred.

Language: Fluency (oral and written) in English required.
